General Terms of Sale

1. Purpose
These General Terms of Sale (hereinafter "GTS") define the conditions under which the company PISKEE (hereinafter "the Provider") provides the SEEGEA service (hereinafter "the Service") to its professional clients (hereinafter "the Client").
These GTS supplement the Terms of Use of the Service.
2. Plans and Pricing
2.1 Available Plans

Prices shown are in euros excluding tax (excl. tax). Applicable VAT will be added to the price excluding tax at the rate in effect.
2.2 Price Changes
The Provider reserves the right to modify its prices. Any modification will be notified to the Client by email at least 30 days before it takes effect. The Client may cancel their subscription if the new prices are not acceptable.
3. Subscription and Payment
3.1 Subscription
Subscribing to a paid plan is done online from the SEEGEA application. The Client selects their plan and enters their payment information through the secure Stripe platform.
3.2 Payment Terms
- Payment is monthly, automatically charged by credit card via Stripe
- The first payment is made at the time of subscription. Subsequent payments are charged on the anniversary date
- Accepted payment methods: Visa, Mastercard, American Express
3.3 Invoicing
An invoice is automatically issued with each payment and accessible from the account settings. Invoices comply with French legal requirements.
3.4 Payment Default
In the event of a payment failure, the Client is notified by email. A 7-day grace period is granted to regularize the situation. After this period, access to the Service may be suspended. In the event of persistent non-payment, late payment penalties at the statutory rate are applicable, as well as a fixed recovery indemnity of EUR 40 (art. L.441-10 of the French Commercial Code).
4. Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the consumer's consent.
As the Service is intended for professionals (B2B), the provisions relating to the right of withdrawal under the Consumer Code do not apply. Nevertheless, the Free plan allows testing the Service without commitment.
5. Duration and Renewal
The subscription is taken out for an indefinite period, with monthly billing. The subscription is automatically renewed each month unless cancelled by the Client.
6. Termination
6.1 By the Client
The Client may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period. No pro rata refund will be issued for the remaining period.
6.2 By the Provider
The Provider may terminate the subscription in the event of a serious breach by the Client of their obligations, after a formal notice that has remained without effect for 15 days.
6.3 Consequences
Upon termination, the Client retains read-only access for 30 days to export their data. Data is then deleted in accordance with the privacy policy.
7. Warranties and Limitations
7.1 Warranty of Conformity
The Provider warrants that the Service conforms to its description and the features described in the ToU.
7.2 Limitation of Liability
The Provider's liability is limited to direct and foreseeable damages, up to the amount of sums paid by the Client during the preceding 12 months. The Provider shall not be held liable for indirect damages (loss of revenue, data, customers, etc.).
8. Intellectual Property
The Service remains the exclusive property of PISKEE. The Client is granted a non-exclusive right of use, limited to the duration of the subscription.
9. Personal Data
The Client's personal data is processed in accordance with our Privacy Policy and, where applicable, our Data Processing Agreement (DPA).
10. Mediation
Although the Service is intended for professionals, in the event of a dispute, the Client may use the consumer mediator designated by the Provider free of charge. The mediator's contact details will be provided upon request.
11. Applicable Law
These GTS are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Compiegne.
